Fighting Identity Theft & Fraud with the
FTC's Red Flags Rule

The Fair and Accurate Credit Transactions Act (FACTA) of 2003 requires all financial institutions and "creditors", including realtors, lawyers, doctors, dentists and other service providers of all types as well as banks, auto and motorsport dealerships, mortgage brokers, tax accountants, retail merchants, education facilities and small business owners to develop and implement a written Red Flags Identity Theft Prevention Program.

 You may say, "I'm not doing it.  I'll take the fines and penalties."

 You may not be able to afford the fines because they could wipe out your business.  Each name in your data base could cost you $2,500. if the Federal Trade Commission decides to fine you.  Some businesses have already been heavily fined for database breaches such as:

1)  ChoicePoint settled with the Federal Trade Commission for $10 million in civil penalties and $5 million for consumer redress.

2)  The Department of Veterans Affairs has agreed to pay $20 million to current and former military personnel to settle a class action lawsuit after an employee reported a portable hard drive stolen or missing

3)  TJ stores (TJX), including TJMaxx, Marshalls, Winners, HomeSense, AJWright, TKMaxx, HomeGoods experienced a database breach experiencing an "unauthorized intrusion" into its computer systems. An InternetNews.com article estimates TJX expenses at $500 million to $1 billion.

4)    Wisconsin Department of Health and Family Services printed social security numbers on about 260,000 informational brochures sent by a third party vendor.  The company agreed to pay $250,000 to the state for the mistake, as well as paying for an identity theft monitoring service for the affected individuals, for a total of about $1 million.

5)  RBS WorldPay belatedly admitted that hackers broke into their systems. A class action lawsuit has been filed against RBS WorldPay.

6)  The CVS Pharmacy chain with 6,300 outlets, has agreed to a $2.25 million settlement with the U.S. Department of Health and Human Services.
